The client is responsible for:

10. PAYMENT TERMS
The Client agrees to make payments according to the quotation, invoice, or proposal provided by Evgrow Marketing.
Unless otherwise agreed in writing:
- 50% Advance Payment only web development services is required before the commencement of any project.
- The remaining 50% payment must be completed before the final website, software, application, or project is made live, transferred, or delivered.
- Projects requiring milestone-based payments shall follow the agreed milestone schedule.

Evgrow Marketing reserves the right to suspend work if payments are delayed beyond the agreed timeline.
Any additional work requested outside the original scope will be quoted and billed separately.
11. PROJECT DELIVERY
Project delivery timelines depend on:
- Project complexity
- Scope of work
- Client approval time
- Availability of required content
- Third-party integrations
- Hosting and domain configuration
Estimated delivery dates are approximate and may change if:
- The Client delays approvals.
- The Client provides incomplete information.
- Additional features are requested.
- Technical issues occur beyond our control.
Evgrow Marketing shall not be held responsible for delays caused by third-party providers such as hosting companies, domain registrars, payment gateways, Meta Platforms, Google, or other external services.
12. CLIENT RESPONSIBILITIES
The Client agrees to:
- Provide accurate business information.
- Supply logos, text, images, videos, and branding materials when requested.
- Review work within the agreed review period.
- Respond promptly to communications.
- Obtain all necessary licenses and permissions for any content provided.
The Client is solely responsible for ensuring that all supplied materials do not infringe upon the intellectual property rights of any third party.
13. REVISION POLICY
Revision requests are limited to the scope defined in the approved quotation or proposal.
Unless otherwise stated:
- Minor revisions are included during the development phase.
- Major design changes, structural modifications, or new feature requests after approval will be treated as additional work and may incur extra charges.
Once a project has been approved or completed, significant redesign requests will be considered a new project.

The Client is solely responsible for all content provided for publication on the Website, including but not limited to:

Evgrow Marketing does not verify the legal ownership or accuracy of client-provided content and accepts no responsibility for copyright infringement, misleading information, or unlawful material supplied by the Client.
15. DOMAIN & HOSTING
Where domain registration or hosting services are arranged through Evgrow Marketing:
- Domain names are registered subject to availability.
- Hosting services are provided through trusted third-party providers.
- Hosting performance, server uptime, or third-party service interruptions are beyond our direct control.
Unless specifically included in the proposal:
- Domain renewal fees are payable by the Client.
- Hosting renewal fees are payable by the Client after the initial service period.
Failure to renew hosting or domain services may result in website suspension or permanent loss of data.
16. INTELLECTUAL PROPERTY
All source code, graphics, website layouts, software architecture, custom designs, documents, proposals, presentations, marketing materials, logos, and creative assets developed by Evgrow Marketing remain the intellectual property of Evgrow Marketing until full payment has been received.
Upon receipt of full payment, ownership of the agreed deliverables will transfer to the Client unless otherwise specified in writing.
Evgrow Marketing reserves the right to display completed projects in its portfolio, website, presentations, and promotional materials unless a separate confidentiality agreement states otherwise.
17. THIRD-PARTY SERVICES
Our services may involve third-party platforms including but not limited to:

18. GOOGLE ADS & META ADS DISCLAIMER
Advertising platforms operate independently and maintain their own advertising policies.
Evgrow Marketing does not guarantee:
- Ad approval
- Continuous ad delivery
- Fixed Cost Per Lead (CPL)
- Specific number of leads
- Sales volume
- Return on Ad Spend (ROAS)

Confidential information shall not be disclosed to any third party without prior written consent unless required by applicable law.
This obligation shall survive the completion or termination of the project.
20. COMMUNICATION CONSENT

Project Cancellation
The Client may request cancellation of a project by providing written notice.
However:
- Work completed up to the date of cancellation shall be chargeable.
- Any advance payment made is non-refundable once work has commenced.
- If third-party services (such as domain registration, hosting, premium themes, plugins, software licenses, APIs, advertising credits, or subscriptions) have been purchased, those charges are non-refundable.
Refund Policy
Refunds shall only be considered in the following exceptional circumstances:
You can request a refund due to our agency's failure only
- Evgrow Marketing is unable to commence the project due to reasons solely attributable to the Company.
- Duplicate payment has been received.
- A technical billing error has occurred.
No refund shall be provided for:
- Completed work.
- Approved designs or development.
- SEO services.
- Digital marketing campaigns.
- Paid advertising budgets.
- Website maintenance.
- Software development.
- Mobile application development.
- Consultation services.
- Graphic design or creative work already delivered.

23. SERVICE SUSPENSION & TERMINATION
Evgrow Marketing reserves the right to suspend or terminate any service immediately if:
- Payment obligations are not fulfilled.

- The Client engages in abusive, unlawful, fraudulent, or unethical conduct.
- The Client requests activities that violate applicable laws or platform policies.
- The Client breaches these Terms & Conditions.
Upon termination, all outstanding invoices shall become immediately due and payable.
24. LIMITATION OF LIABILITY

26. FORCE MAJEURE
